Custom Dog Design - Terms and Conditions

Our desire is to satisfy our clients. One way is to make clear our understandings with each other. These are the terms of our agreement together:

We Want To Make Sure That Your Site Gets online ASAP!

Websites are created on a scheduled basis. Completion of your site depends on how quickly you get us the materials to work with. If you get all of your photos to us on time we can start on your site as scheduled. You are resposible for sending your photos and page content to us within 5 days of purchase to ensure that your site is created as soon as possible. If you can't get the content to us within that time frame we will simply work on the next site in line. Once you have submitted all of your photos and page content let us know and we will complete your site asap. We cannot begin your project untill all photos and pg content is provided. Any new photos sent afterwards will result in an update fee to change banners and graphics, adding new dogs etc.
(If we have not received all of the information to complete your site within 30 days of your order, your site will be considered finished and maintenance fees will apply to complete it. No refunds.)

Hosting and Domain Renewal are billed by your hosting company, it is your responsibility to keep track of this so your website stays online at all times. Once a site has been offline because your hosting/domain expired there is a fee to put the website back online because of the uploading time required. Depending on how long you leave your site offline will determine whether your files has been deleted from our system and your hosting account.

1. Authorization. The client is engaging RCK Designs, as an independent contractor for the specific project of developing and/or improving a World Wide website to be installed on the client's web space on a web hosting service's computer. The client hereby authorizes RCK Design to access this account, and authorizes the web hosting service to provide RCK Design with "write permission" for the client's webpage directory, cgi-bin directory, and any other directories or programs which need to be accessed for this project. (This permission can be emailed.)

2. Standard Website Package Elements. RCK Designs includes the following elements in their Standard Website Packages:

E-mail consultation General Internet orientation education and Web design consultation. If phone consultation is desired long distance charges are in addition to package rates quoted.
Words of text supplied by the client. Webpages of more than 1,200 words of text may be subject to additional fees, especially if they require a great deal of formatting.
Links to external pages.
Custom Graphics Package. Masthead/Banner graphic and/or logo on first page (custom graphic incorporating company logo). Top-of-page graphic for all other pages in your website. Colorful lines and bullets, and colored or textured background.
Photos and other misc. graphic images supplied by client
Installation of web pages on the client's web hosting service.
E-mail response link on each webpage to any e-mail address the client designates.
Meta Tags. This is hidden keywords placed in your home pg for search engines and internet crawlers. Keywords and phrases help your site to be found quicker and easier in search engines.

3. Standard Website Packages. The content of the web pages will be supplied by the client and executed as specified by the client. Please send us your final text. Time required to make substantive changes to client-submitted text after the web pages have been constructed will be additional, billed at an hourly rate.

4. Web Design Fees. The client agrees to pay RCK Design for each page designed determined by the web packaged purchased or the custom design quoted. Any additional pages will carry the same design fee. After one year design fees will be assessed on a fair value basis determined by RCK Design. Flash designs may incur and additional fee.

5. Website Maintenance. Web site maintenance services include revising, editing, or otherwise changing existing web pages to keep your website up to date. The worth of keeping a website is its ability to maintain current information online at a reasonable cost. We assume that you want to revise some or all of your web pages over time, as well as adding additional web pages. RCK Design offers the following Options for website maintenance.

Option 1 - If you feel that you will not make many changes to your website over time, we can provide web site maintenance services on a per each basis, at a min $7.00 per each, with a $ 14.00 minimum charge. The minimum charge is necessary to cover uploading time for changing your website. These rates are consistent with our website development charges. These rates are subject to change without notice.

Option 2 - If you believe you will be making regular changes to your website over time, you can save money by purchasing a web site maintenance contract. A web site maintenance contract is for a one-year term, and is non-refundable. The monthly charges for maintenance are based on the size of your website at the time the contract is signed. The Standard Monthly fee is $50 per month. This fee is a per month fee and is incurred each month for a 12 month period.

Option 3 - Pay Annually $570.00 (An additional 5% savings)

No other parties shall have the right to change the web site. If The Customer or an agent other than RCK Designs attempts updating the web pages, time to repair web pages will be assessed at an hourly rate, and is not included as part of the maintenance contract.

6. Completion Date. RCK Designs and the client must work together to complete the website in a timely manner. We agree to work expeditiously to complete the website. After the period of 30 days from the last content sent by client and work perform by RCK Designs the site is considered complete and any additional work will incur maintenance costs.

7. Payment of Fees. Fees to RCK Designs are due and payable on the following schedule:

Hosting Fees. Prepaid prior to start of design, as that these fees are paid to a company outside of RCK Designs.

Design Fees. All design fees must be paid in advance prior to starting the work. For sites over $1000, 60% is required to begin your custom website project, the remaining 40% is due when the web pages have been constructed according to the client's original written specifications. Only after all payments are received will the site be uploaded to the clients hosting account.

8. Assignment of Project. RCK Designs reserves the right to assign subcontractors to this project to insure on-time completion.

9. Legal Stuff. RCK Designs does not warrant that the functions contained in these web pages or the Internet website will meet the client's requirements or that the operation of the web pages will be 100% uninterrupted or error-free. The entire risk as to the performance of the web pages and website is with hosting company. In no event will RCK Designs be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if RCK Designs has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

10. Copyrights and Trademarks. The client represents to RCK Designs and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to RCK Designs for inclusion in web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend RCK Design and its subcontractors from any claim or suit arising from the use of such elements furnished by the client. All graphics, text, photo, designs, trademarks furnished by RCK Design remain the property of RCK Designs and are copyrighted. The client has permission to use for the sole purpose of displaying on website designed by RCK Designs. Additional fees may apply if graphics are required for other uses such as tshirts, business cards, banners etc.

11. Laws Affecting Electronic Commerce. From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend RCK Designs and its subcontractors from any claim, suit, penalty, tax, or tariff arising from the client's exercise of Internet electronic commerce.

12. Copyright to Web pages. Copyright to the finished assembled work of web pages produced by RCK Design is owned by RCK Design. Upon payment of this contract, the client is assigned rights to use as a website the design, graphics, and text contained in the finished assembled website. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. RCK Design and its subcontractors retain the right to display graphics and other Web design elements as examples of their work in their respective portfolios.

13. Payment of fees. In order for RCK to remain in business, payments must be made promptly. Delinquent bills will be assessed a $5 charge if payment is not received within 10 days of the due date. If an amount remains delinquent 30 days after its due date, an additional $25.00 penalty will be added for each month of delinquency. RCK Design reserves the right to remove web pages from viewing on the Internet until final payment is made. In case collection proves necessary, the client agrees to pay all fees incurred by that process. This agreement becomes effective only when signed by RCK Design.

If we have not received all of the information to complete your site or design project within 30 days of your order, it will be considered finished and maintenance fees will apply to complete it. No refunds will be issued.

By using RCK Designs the client agrees to the terms of this agreement on behalf of his or her organization or business.

TIPS - How To Take Photo Of Your Dogs

Photos should be taken outside on a well lit day without hard shadows covering your dog. First and foremost make sure your dog is clean. Place your dog on a hard surface to ensure that his feet will be visible for your page header and any custom graphics. When taking your photos make sure you do not omit feet, tails and ears from the photo and that the entire body is visible. Take 3 each front, side and front angled shots of each dog and send the photos in the original size to us. We will crop and resize your photos as needed. You can send your photos by email or by uploading them to a free www.photobucket.com account online. Be sure to send us the link to your account so we have access to your uploaded photos. Don't forget to properly name each photo to help identify each dog. High resolution photos are needed for the best website graphics and ANY printed material. Great photos insure a great site!
